Terms of Service

1. Who we are

gopickmybrain (gopickmybrain.com) is operated by GoPickMyBrain, based in Ireland ("we", "us"). You can contact us at hello@gopickmybrain.com.

2. What gopickmybrain does

gopickmybrain lets people ("Experts") create a public page showing the sessions they offer, their prices and their availability. Other people ("Bookers") can use that page to arrange a session with an Expert.

We provide the booking tool only. We are not a party to any agreement between an Expert and a Booker. We don't employ, endorse, vet or supervise Experts, and we don't guarantee the quality, accuracy or outcome of any session or advice.

3. Payments

• Bookers pay Experts directly using a third-party payment service the Expert chooses, such as Revolut, PayPal, Venmo or another payment link.
• We never receive, hold or process the payment. Your payment is governed by the terms of the payment service you use.
• Experts confirm in their dashboard whether payment was received. A booking may be cancelled if payment isn't confirmed within 48 hours.
• Refunds, cancellations and disputes are between the Booker and the Expert. We'll help put you in touch where we can, but we can't issue refunds or reverse payments.

4. Fees

gopickmybrain is currently free to use. We may introduce paid features or fees in the future. If we do, we'll give you at least 30 days' notice before any charge applies to you, and you can stop using the service at any time.

5. Your account

• You must be at least 18 to create an account or make a booking.
• Give accurate information and keep your sign-in details secure. You're responsible for activity on your account.
• You can delete your account at any time from your settings or by contacting us.

6. If you're an Expert

By offering sessions, you agree that:

• You'll describe yourself, your experience and your sessions honestly and accurately.
• You're responsible for the advice you give, the sessions you deliver, and honouring the bookings you accept.
• You're responsible for your own taxes, business registration, insurance, and complying with the terms of the payment services you use. (Some payment services, including Venmo and PayPal, require a business account for regular payments for services.)
• If your field is regulated (for example legal, financial, medical, psychological or other professional advice), you'll only offer services you're qualified and permitted to provide, and you'll follow the rules of your profession.
• You'll handle Bookers' personal information (such as names, emails and phone numbers) only to deliver the session you agreed to, and in line with data protection law.
• You'll handle refund and cancellation requests fairly and in line with consumer law.

7. If you're a Booker

• Sessions are provided by independent Experts, not by gopickmybrain.
• Unless an Expert is a qualified professional providing a regulated service, advice in a session is general information. Use your own judgement and get professional advice where it matters.
• Please turn up on time and treat Experts with respect.

8. Things you must not do

You must not use gopickmybrain to:

• break any law or help anyone else do so;
• impersonate anyone or misrepresent your qualifications;
• offer anything illegal, harmful, sexual, deceptive or fraudulent;
• harass, abuse or threaten anyone;
• send spam, scrape the site, or try to break, overload or get around our security;
• collect payments for sessions you don't intend to provide.

9. Your content

You own the content you add, such as your name, photo, bio and session descriptions. You give us permission to display, host and share it as needed to run the service, including on your public page and in previews when your link is shared. You confirm you have the right to use anything you upload.

10. Suspending or removing accounts

We may remove content, suspend or close accounts that break these terms, receive credible reports of misconduct, or put others at risk. Where reasonable, we'll tell you why.

11. The service is provided "as is"

We work hard to keep gopickmybrain running smoothly, but it's an early-stage service. We can't promise it will always be available, error-free or secure, and features may change.

12. Our liability

• We're not responsible for sessions, advice, payments, refunds or disputes between Experts and Bookers, or for third-party services such as payment providers, video calling or email.
• To the extent the law allows, our total liability to you for any claim relating to the service is limited to €100.
• Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. If you're a consumer, your statutory rights are not affected.

13. Changes to these terms

We may update these terms as the service develops. If we make a significant change, we'll let you know by email or on the site before it takes effect. Continuing to use the service after that means you accept the updated terms.

14. Governing law

These terms are governed by the laws of Ireland, and the Irish courts have jurisdiction. If you're a consumer living elsewhere in the EU or UK, you also keep the protection of the mandatory laws of your country and can bring claims in your local courts.
